Resumen
In this research paper, we will inform the reader of the constitutional importance of financial activity as a gender and banking activity as a species, in particular by referring to one of the typical banking operations practiced in the financial markets by the institutions of the sector, as is the gathering of resources from the public. This operation is classified within the category of "Passive Operations", having a double functionality in the development of banking activity. Now, because it is an activity where, who exercises it, manages, invests and takes advantage of public money, the Constitution of Colombia, foresees that it must be intervened by the State, this is an extremely important aspect that will be a determining basis in order to give an understanding of the importance of the state's duty to monitor this economic sector.
Moreover, the basic concepts and notions regarding the low-value payment systems “LVPS”, an activity that is within what constitutes financial activity, both by the nature of its acts and by its participants, will be presented, leading to its constitutional protection. Its importance has been increasing in recent years in the sector, thanks to the collaboration of the technological
infrastructures that have allowed the extension of the system for natural and legal persons, achieving greater access and ease in the execution of transactions, in turn accelerating. the supply of products and services by the financial system and consequently, generating greater economic growth.
Finally, it will seek to inform the reader about the problem of the non-exercise of state surveillance over all the actors of the "LVPS" as part of the financial activity, based on the fact that, as it belongs to this economic sector, it must be given the importance of constitutional rank that it has, this means that the state intervention must be total on its participants in order to avoid the insecurity of the people in the system and the possible risks belonging to that activity.
