This investigation focused on the judicial activism of the Constitutional Court, where the Constitutional Court has developed the origin of the Tutela Action against judicial decisions, reason for discord with the other highest courts, which has generated the so-called "Train Clash" that the violation of access to justice and effective judicial protection has been of great importance.
It could be said that judicial activism is a function that goes beyond the judicial scope and is integrated into the legislative sphere, that is, filling legal gaps through judicial pronouncements.
An important precedent was the C 543 of 1992 which is framed in a decision of judicial activism, which has had a leading role in the decisions of the judges that make up the High Court in Colombia.
