Resumen
The purpose of this article is to analyze the possible violation of the constitutional right to habeas data, when including an indemnity clause in an agreement subscribed between a public entity and a data operator.
For the investigation, it will be explore the obligations of the public entities, as sources of information; as well as the obligations imposed to financial data operators, and the link between those and the constitutional right of habeas data.
On the other hand, it will be expose the contradictory effect of the compensation clause, imposed in commercial contracts, against the obligations of data sources and operators.
Finally, this investigation will analyze the possible violation of the constitutional right to habeas data, when including an indemnity clause in contracts between public entities and data operators, given that this type of dispositions can exonerate the defendant source, from petitions, complaints and claims before the information owners.
