Protección legal del ingenio productor de semillas y la responsabilidad civil derivada de su creación, registro, producción y comercialización

Abstract

The effect of globalization in the economic sphere has marked an important pattern in society, which warns that one of its main drivers is innovation. This is because it promotes the economic growth of a country, opening investment opportunities, generates jobs and contributes to improving the quality of life of individuals. However, this innovation requires a large investment from the economic point of view, hence it is protected by intellectual property. In the case of seeds, this innovation is protected through two forms, on the one hand, the innovation of plant breeding that is protected by breeder's rights, which are based on the International Agreement for the Protection of Plant Varieties. And on the other, the results of the application of biotechnology for intellectual property rights, these come from human ingenuity and are therefore susceptible to protection, in this case through patents. For this reason, the present investigation will analyze the importance of the different protection mechanisms directed to the seed-producing mill and the main aspects surrounding the legislation on the subject.
