Abstract

It is proposed to review by way of sketches how indigenous people are understood today based on what has been investigated by other authors, which will be a sufficient basis for understandingthe indigenous paradigm from the contemporary; For this, the starting point will be to begin with the same constitutional structure, defining a possible problem that is found when two articles of the 1991 Constitution are considered, that is, article 13, second and third paragraph, versus article 14, facing the indigenous understood as an individual. Once the above is done, it will be examined whether the indigenous are addressed in terms of article 14 of the Constitution, that is, if it is feasible for them to exercise legal personality, or if, on the contrary, it is easier for the indigenous to seek to be labeled as an outsiders in the words of Becker (2009) waiting to be protected, denying him as a consequence the full exercise of recognition of legal personality in a post-industrial world whose movements are completely economic
