Resumen
Our Constitution of 1991, in its first article states that Colombia is a social state of law, which seeks to guarantee the fundamental rights and principles of all its partners, in addition to the prevalence of general interest, which is the starting point for the development of this research, because as established by Article 58 of the constitution, the individual must bear public burdens imposed by the State when, for reasons of public utility and social interest through a process of expropriation administrative limits their right to private property in exchange for compensation, for all damages caused to the affected, which jurisprudencialmente must be fair, full and complete. So, we enter to determine whether the procedure laid down in article six of Act 1742 of 2014, regarding the payment for the value of the property at the stage of expropriation, whether judicial or administrative violates constitutional rights and principles.
