Privatización Carcelaria, Medio para la Superación de Estado de Cosas Inconstitucional en el Sistema Nacional Penitenciario y Carcelario en Colombia

Abstract

The repeated violation of the fundamental rights of the prison population has led to the declaration of the State of Unconstitutional Things (ECI) at the National Penitentiary and Prison Institute (INPEC) in Colombia by the Constitutional Court, however, the policies adopted by the Government based on the orders issued by the high court have not led to the overcoming of the prison crisis in the country. This article is intended to generate a critical analysis and Constructive, based on the study of the declaration of the unconstitutional State of Things at the National Penitentiary and Prison Institute in Colombia, under a historical look, comparative work with different countries with similar problems and a proposal following assessments and studies on how to overcome the current prison crisis.
