Análisis de las prestaciones económicas por muerte en la familia de crianza a la luz de la sostenibilidad financiera

Abstract

This investigation work is oriented to study juridically the beneficiaries of the economic assistances for death that are exhaustively enshrined in the General Pension System and the analysis of the foster family as a new family typology that has been emerging due to the social evolution, and with these determine the feasibility of including members of this family type as beneficiaries of the survivor's pension and the pension substitution, within the framework of financial sustainability, taking as reference the social reality, the jurisprudential treatment of the High Courts regarding the theme, as well as the analysis from the creation of the Social Security System to determine the effectiveness or not of the normative reforms issued against the aforementioned principle. Conducting also an analysis of the principles that underpin the Colombian pension system and the principles related to the concept of family, in light of the essential theory of fundamental rights.
