Resumen
The Colombian criminal process establishes, among others, the standard of proof beyond a reasonable doubt (to convict). The presumption of innocence is related to the standard of proof because it is the threshold that the hypotheses raised as facts of the cause must exceed for the judge to convict. If the threshold is not exceeded, the principle in dubio pro reo is applied and the defendant is acquitted. On the other hand, in the civil process there is no standard. The judge must evaluate the evidence using sound criticism and justify his decision according to the rules of science, rules of logic and maxims of experience. Even so, the decisions of the civil judge are based, in terms of probability, on the truth. However, there is no clarity on when that truth necessary to pass sentence is reached.
