Resumen
The Colombian State is classified as a social State of law, where it recognizes, guarantees and promotes the fundamental rights of all its citizens regardless of their race, sex or origin, allowing access to the guarantees, bines and services of all its citizens without any discrimination.
The present investigation arises from the need to demonstrate the legal gap that exists in the legal system, in the protection and guarantee of fundamental rights for Venezuelan migrants who live on the streets of the municipality of Bucaramanga, Santander, despite the existence of regulations in the legal system. of constitutional and international rank that recognize, promote, guarantee. This gap is evident in the ignorance of rights and unequal treatment by national and local authorities, by not taking them into account in programs and projects that seek assistance, the restoration of rights and the social inclusion of street dwellers.
