The paper presents a theoretical and legal analysis of the imposition of the death penalty and life imprisonment in Colombia as punitive mechanisms, in light of the commission of heinous crimes that could be being not penalized by existing laws, questioning the credibility and soundness legal and constitutional country. The study is developed taking into account a theoretical component on death penalty in Colombia, through the applicability of the same before the year 1910, when it was established definitively its abolition, defining their impact on past and current prosecutions and reliving its applicability in Colombia at the request of many victims to inhuman cases that have been widely questioned by civil society and without any specific measures to compensate the pain of the victims and their families, but without ignoring the impact it would bring for underserved and at the same time, it could generate the imposition of the measure unfairly as in the current process procedure. A recognition of the constitutional component, whose relationship is given by the various agreements, protocols and conventions guaranteeing the defense of human rights and failure to revive the death penalty in a country that is trying to strengthen its system is further contemplated Judicial and reduce cases of violence that have plagued account for over years.
