Under the new paradigm of participatory democracy enshrined in 1991 Constitution, several communities have tried to use the mechanism of referendum in order to protest against subsoil exploitation, because of their fear about its social and environmental impacts. Those expressions are faced against the advance of mining locomotive, which has been instituted as one of the economic development’s engines by Juan Manuel Santos’ Government. In this context, a possible solution to the dispute can’t disown that the extraction of subsoil resources is an activity which is protected by our legal order, but it must consider that its advance can’t continue without a social dialogue with communities, in order to safeguard their fundamental right to political participation.
