Aportes a la teoría jurídica crítica : debate modernidad / postmodernidad en el derecho

Abstract

The crises that shook the feudalism led to the renaissance, the origin of “modernity”, and consolidate the “rationality” as a platform for human thought. It developed a liberal political-economic order and legal positivism, which has manifested in the modern dichotomy: state-law, and their reproduction in their couple legality-legitimacy. In the mid-twentieth century, the modern paradigms entered into crisis, glimpsed by modernizing project depletion by postmodernists, contrary to the ideals of modernity unfinished. Globalization urges us to reflect on the legal narrative enunciate by Eurocentric modernity, so that from American principles such as the philosophy of liberation build alternative notion of law, whit pretensions to overcome economic inequality and justify the development persons of integrity.
