dc.description.abstract | Illegal gold mining in Colombia, focuses in the department of Antioquia, where the biggest farms of this mineral, mostly illegal, but also legal, beneficial mostly to groups outside the law. It is therefore the legal issue raised is precisely determine, why illegal gold mining in the department of Antioquia, is benefiting subversive groups and criminal gangs? For as evidence, the extraction of mineral resources is an industrial activity that generates noticeable direct and indirect impacts on the environment; It is for this reason that the mining industry must be filed in the field of business formality, ensuring results in terms of protection of public interests, within which renewable and non-renewable natural resources, environment and society are included.
To perform this research exercise the hermeneutical method is applied as a method of interpretation of legal texts, or positive legislation as a whole, not only by all provisions which form the legal system, but by the rules and principles that constitute the doctrine applicable to the legal system on the issue for the sake of the search for meaning and comparison of different texts and views on the subject as well as the different interpretations on it have done different courts.
