Resumen
In Colombia, the Consumer Statute (Law 1480 of 2011) enshrined the consumer's right to be protected from misleading advertising which is defined in Article 5 of the statute, as the advertising which its content does not correspond to reality or is not sufficient and that may induce or induce to error, deception or confusion to the consumer.
However, Colombian legislation did not foresee another type of advertising used by companies to persuade consumers to purchase the goods and services they produce in an unconscious manner through messages that are not perceived by the senses and that affect them in their consumption decisions, that is, subliminal advertising. This article aims to determine how consumers rights are violated in Colombia, since there is no regulation to protect them from this type of advertising. Under this framework, it is necessary to address the concept of consumer rights in Colombia, review the protection given to consumers against misleading advertising and finally analyze how consumers rights are violated when using subliminal advertising.
