Resumen
The second section, subsection B, such as the Constitucional Court, the Third Section, Subjection A in relation to the motivation bof the discretionary acts of withdrawal from service of employees who work related to the security of the state insecurity legal and lack of legitimate trust in associates. Why is it present as a research question? By virtue of the process of constitutionalization of administrative law is it necessary to motivate withdrawal acts in the positions that belong to the State security services?
This is one of the Military Forces, National Police and INPEC, because (i) it is constitutionally supported in the Article 29 above, which by virtue of th constitutionalization of the rigth materializes the Social State Of Law (ii) The disparity of decisions adopted by the Constitutional Court and the Council of State, generate an atmosphere of certainty to the associates.
It was concluded that the divergence of positions between the Council of State and the Constitutional Court genres of difference of treatment for the associates, which refers to the equality of rights, the legitimate, the systemic coherence and legal certainty because the associates cannot receive diverse treatment according to the natural judge of the process, in addition to articles 25.2 and 25. 2 of the American Convention of Human Rights (Constitutional Court, T-251, 2009). In this senese, regarding the motivation as materialization of a social and jurisdictional control of administrative act, it is understood as the nominators in the unmotivated act, not only the minimum procedural guarantees of the administrators, are unknown, but their act is also unknown.
