La prueba ilícita en el proceso penal colombiano: excepciones a su exclusión

Abstract

The rule of exclusion of illegally achieved evidence is a tool for the protection of human rights within the criminal process, through which it is intended to prevent the Judge from basing the decision on criminal responsibility on evidence that violates the law legal and people's rights. However, jurisprudence and legislation have constructed a wide variety of exceptions that prevent the application of this figure to its full extent. It is essential to understand this legal institute so that illicit evidence is only admissible in truly exceptional events.
