Resumen
This article is built from the documentary review of the Health Contract in Colombia. Specifically, the implementation of the General Health System is analyzed, which is based on the principles of equity, universality, and protection, with which the aim is to guarantee the social right to health, through promotion, prevention, prognosis, treatment, and rehabilitation.
Using the qualitative methodology, a general study of the Health Contract was carried out, understood as a Social Contract, as established in article 49 of the Political Constitution of Colombia. The primary purpose of this Contract is to safeguard the fundamental right to health considering that, being a right constitutionally enshrined as an essential public service, it is a duty of the Social State of Law to guarantee it. In this way, the State as responsible must organize, direct, and regulate services and health care.
That said, the objective of the research is to analyze the Health Contract in Colombia and specially related to the trans population, the LGBTI Public Policy, as well as the legal development of the contracting between the EPS and the IPS in Colombia, to determine what are the failures and what administrative barriers are presented to people with trans life experiences when accessing medical-surgical services.
