El proceso de restitución de inmueble arrendado en Colombia: vulneración al derecho a la vivienda digna

El tema de esta investigación es el proceso de restitución de inmueble arrendado destinado para vivienda ante mora del inquilino y su compatibilidad con el derecho humano a la vivienda digna. Para tal fin, este texto inicia abordando el derecho a la vivienda digna y el concepto de vivienda vulnerable dese una perspectiva del derecho internacional, analiza su tratamiento normativo y jurisprudencial y posteriormente contrasta dicho análisis con el proceso de restitución de inmueble arrendado en Colombia. Este texto concluye evidenciando como el privilegio del legislador y la Corte Constitucional por la protección al derecho a la propiedad privada termina por vulnerar el derecho a la vivienda digna. En este documento se analiza cómo el estado de condiciones actuales de dicho procedimiento, es decir, las disposiciones legales que lo regulan, implican una serie de vulneraciones para con los hogares vulnerables. Lo anterior se debe a que las cargas procesales que deben asumir los demandados (arrendatarios) para ser oídos durante el proceso son excesivas y en la mayoría de los casos imposibles de cumplir, pues para ser oídos, deben cancelar la totalidad de los cánones adeudados y los causados durante el proceso. El hecho de no ser oídos en el proceso, significa que el arrendatario no se podrá defender y el juez dictará sentencia de plano restituyendo el inmueble; frente a esta decisión no cabe recurso de apelación alguno; dicho en otros términos, de no pagar la totalidad de los cánones, los arrendatarios serán desalojados del inmueble sin poder defenderse o establecer propuestas de acuerdos. The subject of this research is the process of restitution of leased property intended for housing in the event of tenant default and its compatibility with the human right to adequate housing. To this end, this text begins by addressing the right to decent housing and the concept of vulnerable housing from an international law perspective, analyzes its regulatory and jurisprudential treatment and then contrasts this analysis with the process of restitution of leased property in Colombia. This text concludes by showing how the privilege of the legislator and the Constitutional Court for the protection of the right to private property ends up violating the right to decent housing. This document analyzes how the current conditions of this procedure, i.e., the legal provisions that regulate it, imply a series of violations against vulnerable households. This is due to the fact that the procedural burdens that the defendants (tenants) must assume in order to be heard during the process are excessive and in most cases impossible to comply with, since in order to be heard, they must pay all the fees owed and those caused during the process. The fact of not being heard in the process means that the lessee will not be able to defend himself and the judge will issue a flat judgment restoring the property; there is no appeal against this decision; in other words, if the lessees do not pay the full amount of the fees, they will be evicted from the property without being able to defend themselves or establish proposals for agreements.
