"La investigación analiza los alcances de la Opinión Consultiva OC-23/17 de la Corte Interamericana de Derechos Humanos, al ser el pronunciamiento más reciente sobre el medio ambiente y derechos humanos del tribunal. Siendo necesario determinar cuáles son dichos alcances, efectos y retos reales de la Opinión Consultiva OC-23/17 de la Corte IDH, frente a la posibilidad de establecer una protección judicial contenciosa internacional del derecho al medio ambiente sano como derecho "humano" autónomo. Para dar una respuesta a la pregunta es esencial ahondar en la naturaleza jurídica, definición conceptual, y el alcance de la protección internacional del derecho al medio ambiente sano en el SIDH, para (i) reiterar la conexión existente entre este derecho y otros derechos humanos que los hace indivisibles, (ii) abordar la distinción problemática entre la categorización de derechos económicos, sociales y culturales, y los derechos civiles y políticos, por la diferenciación de los mismos a la hora de ser judicializados ante la Corte IDH, y (iii) abrir la discusión de que la Corte IDH falle de manera contenciosa casos en torno al derecho al medio ambiente sano. La investigación se divide en (i) la construcción de las clasificaciones de derechos humanos; (ii) el corpus iuris del derecho internacional de los derechos humanos y del SIDH; (iii) el origen de la protección al derecho al medio ambiente sano como derecho humano; (iv) la competencia de la Corte IDH; y (v) el contenido de la Opinión Consultiva OC-23/17 sobre el derecho al medio ambiente sano como derecho "humano" justiciable ante la Corte IDH."--Tomado del Formato de Documento de Grado. "This thesis analyzes the scope of the Advisory Opinion OC-23/17 given by the Inter-American Court of Human Rights. It is the most recent statement about environmental and human rights decided by the court. It is necessary to determine what are the scope, effects and challenges given by the Advisory Opinion OC-23/17 of the Inter-American Court of Human Rights for the establishment of international judicial protections in dispute resolutions concerning the right to a healthy environment as an autonomous human right. To answer the question proposed, it is essential to deepen in the legal nature, the conceptual definition and scope of the protection of the right to a healthy environment in the Inter-American Human Rights System. This entails (i) to reiterate the existing connection and indivisibility between this right and other human rights, (ii) to tackle the problematic distinction within the Inter-American Court of Human Rights between social, economic and cultural rights and civil and political rights, and (iii) to reopen the discussion about the necessity of a contentious judicial protection within the Inter-American Court of Human Rights in order to better resolve disputes concerning the right to a healthy environment. The investigation is divided into (i) the origin of the categorization of human rights, (ii) the corpus iuris of the International Law of Human Rights and of the Inter-American Human Rights System, (iii) the origin of the international protection of the right to a healthy environment as a human right, (iv) the jurisdiction of the Inter-American Court of Human Rights; and (v) the content of the Advisory Opinion OC-23/17 about the right to a healthy environment as an autonomous human right actionable and subjected to review before the Inter-American Court of Human Rights."--Tomado del Formato de Documento de Grado.
