Portabilidad de aportes pensionales como mecanismo de garantia alterna a los convenios bilaterales de seguridad social suscritos por Colombia

Abstract

International agreements are a special mechanism of protection of fundamental rights. Colombia has subscribed to several social security bilateral international agreements. These agreements include the protection of the right to social security of migrant workers. The practical enforcement within the framework of these agreements is limited due to migrant workers having contributed to the social security systems of multiple countries. On completion of an individual’s work life, the application of the agreements results in a division of the pension benefit. Allowing pension funds to be transferred between countries protects the rights of the migrant worker to social security and provides a safety net for migrant workers globally.
