In contexts of transition from war to negotiated peace, alternative transitional justice mechanisms in the fields of investigation, trial, punishment and reparations, such as the granting of benefits, case selection, amnesties and pardons, often collide with the State's obligation to investigate, prosecute and punish in accordance with International Human Rights Law. This paper examines the fulfillment of said international obligation, within the framework of the Special Jurisdiction for Peace, taking as a reference the Macro Case No. 06 “Victimización de miembros de la Unión Patriótica (UP) por parte de agentes del Estado”. That is, in order to identify whether the Colombian State is fulfilling its obligation to investigate, prosecute and punish, while ensuring that the rights to truth, justice, reparation and non-repetition of the victims of serious human rights violations are respected.
