Aplicación del régimen probatorio del Código General del Proceso en la reparación integral a víctimas de delitos sexuales: efectos de la sentencia 47.076 del 2016 de la Sala de Casación Penal de la Corte Suprema de Justicia

La estructura del trabajo se inicia con la contextualización del concepto de delito sexual, el daño que produce, el IRI, su régimen probatorio, el concepto de perjuicios inmateriales en materia de víctimas, haciendo alusión a los diferentes tipos de perjuicios inmateriales reconocidos por la jurisprudencia. Se identifica el desarrollo y la evolución jurisprudencial sobre los criterios objetivos y subjetivos frente al quantum indemnizatorio en materia de perjuicios inmateriales, así como las medidas de restablecimiento no pecuniarias y las repercusiones de su aplicación por parte de los funcionarios de conocimiento. Finalmente, se plantea una tesis central, en la cual se defiende la adopción de un régimen probatorio oficioso al interior del IRI, con decisiones abiertas a indemnizaciones en equidad, que incluya medidas de restablecimiento no pecuniarias con miras a reparaciones más integrales, avalada con las conclusiones del caso. En cuanto al análisis de los doce casos, las decisiones al interior de IRI que en el presente trabajo se relacionan, se obtuvieron del Circuito Judicial de Chocontá (Juzgado Único Penal del Circuito), donde los fundamentos de la decisión para determinar la cuantía a indemnizar se sustentan en la univocidad y precariedad probatoria, los artículos 102 a 106 del Código de Procedimiento Penal relativos al ejercicio del IRI y de fallos jurisprudenciales de las altas cortes, relacionados con los elementos utilizados para ponderar el daño y cuantificar el monto de la reparación, con la consecuente aminorada reparación integral frente a la magnitud de los daños concretos. (texto tomado de la fuente) The structure of the work begins with the contextualization of the concept of sexual offense, the damage it produces, the IRI, its evidentiary regime, the concept of immaterial damages in terms of victims, making reference to the different types of non-pecuniary damage recognized by the case law. . The development and jurisprudential evolution on the objective and subjective criteria against the compensation quantum in the matter of non-pecuniary damage, as well as the non-pecuniary recovery measures and the repercussions of their application by the knowledge officers are identified. Finally, a central thesis is proposed, which defends the adoption of an informal evidentiary system within the IRI, with decisions open to compensation in equity, including non-pecuniary recovery measures with a view to more comprehensive reparations, backed by the conclusions of the case. Regarding the analysis of the twelve cases, the decisions within IRI that are related in the present work were obtained from the Judicial Circuit of Chocontá (Single Criminal Court of the Circuit), where the grounds of the decision to determine the amount to be compensated they are based on the univocity and evidentiary precariousness, articles 102 to 106 of the Code of Criminal Procedure relating to the exercise of the IRI and jurisprudential rulings of the high courts, related to the elements used to weigh the damage and quantify the amount of the reparation, with the consequent reduced integral reparation in front of the magnitude of the concrete damages.
