Efectos de la nulidad declarada sobre un contrato de transacción

Abstract

El siguiente proyecto analítico busca explicar y resolver, conforme la legislación chilena, los efectos de la nulidad declarada sobre un contrato de transacción a efectos de poder responder la siguiente interrogante: ¿En qué situación quedan las partes, posterior a la declaración de nulidad sobre un contrato de transacción? Analizando la jurisprudencia nacional, la doctrina chilena y comparada, el siguiente proyecto busca responder ese caso, a objeto de poder entender la situación en que fluyen las partes, una vez declarada la nulidad sobre el contrato de transacción, el cual buscó, en su momento, poner término a un litigio pendiente o precaver litigio eventual. Para responder a ello se analizará la estructuración del ordenamiento jurídico chileno, la jurisprudencia nacional y como ésta ha fallado, para poder concluir finalmente: ¿Cuáles son finalmente los efectos hacia las partes, los terceros y los bienes posterior a la declaración de nulidad? En consecuencia, este proyecto ahondará en el ordenamiento jurídico nacional y comparado, en cuanto a la nulidad declarada sobre el contrato de transacción

The following analytical project seeks to explain and solve under the Chilean law, the effects of the nullity on a transaction contract in order to answer the following question: In what situation are the parties after the declaration of nullity on a contract transaction? Analyzing the national jurisprudence, the Chilean and foreign doctrine, the following project seeks to answer that case, in order to understand the situation in which the parties be, once the nullity of the transaction contract has been declared, which it sought in its moment to end a pending litigation or to prevent an eventual litigation. To answer this, the structuring of the Chilean legal system, national jurisprudence and how it has failed will be analyzed, to finally be able to conclude: What are the effects on the parties, third parties and property after the declaration of nullity? Consequently, this project will delve into the national and comparative legal system, regarding the nullity declared on the transaction contract
