Aplicación de las TIC en la jurisdicción ordinaria del distrito judicial de PAMPLONA , NORTE DE SANTANDER desde la Vigencia de la LEY 1712 de 2014.

Abstract

The project carried out in the ordinary jurisdiction of the judicial district of Pamplona, the Judicial Branch through the Superior Council of the Judiciary, Administrative Chamber, accepting the different constitutional and legal parameters, ordered the implementation of technological means for simplification, access and consultation of the processes that are processed in the different offices at national level; in this sense, there is the regulation and disposition in the law 1712 of 2014 "By means of which the Law of Transparency and the Right of Access to National Public Information is created and other dispositions are dictated", decree 1008 of 2018 MINTIC that compiled the sole regulatory decree of the sector of information and communications technologies 1078 of 2015 and the PCSJA14-10215 of 2014 and PCSJA1710672 of 2017. notification times, different procedural actions, the easy consultation of the files and the decrease in the consumption of paper, important aspect of environmental policy to take care of the environment that overwhelms the current society. In the juridical exercise that the professionals of the right realize several inconveniences in the consultation of states, notifications, edicts, transfers and other procedural issues that cause a significant loss of time in the judicial stages, situations of which the judicial offices do not escape that they attend in the Norte de Santander Department, reason more to consult the use and impact of the Tic in the Administration of Justice, taking as object of study, the judicial offices. Similarly, the research that will be conducted requires the collection of specific information on multiple aspects that surround the work environment of both internal users (officials and employees judicial branch) to determine the degree of productivity and competitiveness in the public sector judicial.

El proyecto realizado en la jurisdicción ordinaria del distrito judicial de Pamplona, la Rama Judicial a través del Consejo Superior de la Judicatura, Sala Administrativa, acogiendo los diferentes parámetros constitucionales y legales, dispuso la implementación de los medios tecnológicos para la simplificación, acceso y consulta de los procesos que se tramitan en los diferentes despachos a nivel nacional; en este sentido, existe la reglamentación y disposición en ix

la ley 1712 de 2014 “Por medio de la cual se crea la Ley de Transparencia y del Derecho de acceso a la información pública Nacional y se dictan otras disposiciones”, decreto 1008 de 2018 MINTIC que compilo el decreto único reglamentario del sector de tecnologías de la información y las comunicaciones 1078 de 2015 y los Acuerdos PCSJA14-10215 de 2014 y PCSJA17-10672 de 2017. Se resalta esa búsqueda de herramientas tecnológicas para contribuir y mejorar los tiempos de notificación, las diferentes actuaciones procesales, la fácil consulta de los expedientes y la disminución en el consumo de papel, aspecto importante de política ambiental para cuidar el entorno que agobia a la sociedad actual. En el ejercicio jurídico que realizan los profesionales del derecho se presentan varios inconvenientes en la consulta de estados, notificaciones, edictos, traslados y demás asuntos procedimentales que ocasionan una significativa pérdida de tiempo en los estrados judiciales, situaciones de las que no escapan las oficinas judiciales que atienden en el Departamento Norte de Santander, razón más para consultar el uso e impacto de las Tic´s en la Administración de Justicia, tomando como objeto de estudio, los despachos judiciales . De igual forma, la investigación que se realizará requiere de la recopilación de información específica sobre múltiples aspectos que rodea el entorno laboral tanto de los usuarios internos (funcionarios y empleados rama judicial) para poder determinar el grado de productividad y competitividad en el sector público ámbito judicial.
