The due process is a technical body of law also present in popular culture. This paper identifies representative times when popular culture clearly communicates a social recognition
toward due process as institution. We refer especially to two literary, classic and legendary
figures, such as “Robin Hood”, and “The Trial”, by Franz Kafka; additionally, we explain
how the present system of law also shows priority references about that institution. By
means of the due process figure, we want the reader to get nearby the reading of history,
literature, and universal popular culture fields, which embody a very complete conception
of what law refers to.
