Resumen
This work arises from the need to develop a process to grant licenses for patents
with a focus on quality control in an office dedicated to the granting of such
securities. All this in order to reduce the analysis time and study a request from the
area in question and complying with legislation, agreements and regulations
governing the patent office. Thus the proposed process, we expect the Industrial
Property Office is competitive in relation to different offices of the same kind in the
world.
Through the dialectical method of the study of the ongoing patent titling. To this
end, the substantive examination conducted by a group of Industrial Design
Applications, by reference to the data obtained in accordance with the terms of
resolution and number of cases closed. Similarly, to provide better service in the
titling system patent proposes the establishment of a process that is designed with
the purpose of having a better attention to the times and the number of decisions
clearly and accurately the patent office, so that is not omitted any information or
consulting activity mainly during the substantive examination of an application.
By reducing the study time of an application, is satisfied with the commitments
made between the office responsible for examining applications for patents and the
user, and the preservation of legal statutes that involve the granting of applications
for patents that area . It is important to note that the substantive examination is
similar for inventions and utility models, thus reducing the study time is reflected in
all the legal figures Patent area. However, as already mentioned, should be
considered legal statutes for each of the aforementioned legal forms.
It is worth mentioning that this design process model that is proposed to grant
patents, provides the necessary information for use in any office of Industrial
Property. With the above will fall the existing delay to date in any office to apply the
Process Model, considered, especially in the Mexican Institute of Industrial
Property.
