The present study was developed with the objective of analyzing the processes of discharge and non-requirement of tender bid done at UFSM in the last 05 (Five) years (from 2006 through 2010) to understand which reasons promote purchases without previous bidding. The research presented is characterized as a descriptive case study and with a quantitative approach. The data collection was done through the use of the platform SIE (Information Systems and Teaching), which complies with the whole University, through the application General Services – Report: Expenditure Budget by Legal Basis of tender bid and Process. With the analysis, it was possible to verify that the number of purchase processes done by discharge and non-requirement tender bid (articles 24 and 25 from the Law 8666/93, respectively) was really meaningful, but that throughout the investigated period it happened decreasingly. Among the reasons which led to direct hiring, concerning the discharge of tender bid, UFSM made use of 14 out of the 31 cases in Law, with emphasis in the Item II (purchases of little value). As to the non-requirement, all the cases in Law were applied, once it sets the inviability of competition.
