This research aims to understand the processes that involve the provision of nursery classes within the scope of the Santa Maria Municipal Education System in view of the implementation of Law 12,796 / 2013. Specifically, the research aimed to map the organization and maintenance of groups of children from 0 to 2 years old in the public and private schools of Early Childhood Education in the municipality of Santa Maria / RS; to analyze the consequences of the implementation of Constitutional Amendment No. 59/2009 for the education of young children (nursery) in the Municipal Education System of Santa Maria and to deepen studies on public policies aimed at the education of babies in a quantitative and qualitative perspective. The methodology uses a qualitative approach with support of quantitative data, with a bibliographic contribution. The provocative problem of this research was: In what way is the implementation of Law 12.796 / 2013 taking place in view of the offer of nursery classes within the municipal education system of Santa Maria / RS? The studies of Kramer (1988), Libâneo (2007), Barbosa (2010), among others, contributed to the theoretical reflection of this research. In this process, the data collection instrument responses with the CME / SM and SMED management that indicate the growth of classes and nurseries in private institutions were used, while public institutions have closed full-time positions for children and their families.
