Sustainable public purchasing represents a change in the patterns of goods and services acquisitions by the Federal Public Administration, especially from the edition of the Normative Instruction 01/2010, created by the Logistic and Information Technology Department from the Ministry of Planning, Budget and Management (Ministério do Planejamento, Orçamento e Gestão – MPOG). The aim of this study is to identify and analyze the hindrances found by the Regional Superintendent of Labor and Employment in the State of Rio Grande do Sul (Superintendência Regional do Trabalho e Emprego do Rio Grande do Sul – SRTE/RS) in the adoption of sustainable public bidding. In order to evaluate its legality in the field of the Federal Administration, new law instruments and modifications were analyzed in the public contract legislation already applicable through bibliographic research. A semi-structured interview was also used to discover what the SRTE/RS civil servants directly involved with the Institution’s acquisition processes think about the factors that restrain operationalization of ecopurchasing inside the public body studied. There was an effort to examine each point raised by the interview for a better comprehension of the procedure and elucidation of some critical points for the adoption of sustainable bidding. The conclusion was that there are not legal obstacles to include sustainable criteria in the Government bidding. Besides, one can assume that it is possible to make environmentally friendly bidding process happen through adequate motivation and inclusion of relevant demand in the specification of the bidding object.
