Consecuencias económicas de la unión de hecho en la legislación ecuatoriana.

Abstract

Ha sido tema que me ha permitido, analizar y profundizar tanto en la base jurídica positiva nacional, como en las acciones y practicas judiciales, porque he considerado que en el convivir actual, la unión de hecho es ampliamente acogida. Con el fin de comprender la finalidad primordial de la unión de hecho y fundamentalmente las consecuencias económicas que de ella se derivan, se ha tenido que analizar la naturaleza del ser humano, desde su origen y premeditar sus características naturales, que son las que ayudan a la constitución del grupo familiar, que a través de millones de años ha evolucionado desde la promiscuidad del matriarcado, al patriarcado actual. Este tema económico he tenido la oportunidad de analizar en la presente tesis, en base a consultas de derecho positivo, jurisprudencias y costumbres, como un aporte a la nueva convivencia familiar en nuestro País.

The current research work has led us analyzing and getting an insight in the national positive legal base, such as the actions and judicial practices, because I have deemed that in everyday life, the de facto unions are widely accepted. In order to understand the primary purpose of the de facto union and mostly economic consequences derived from it. Nature of the human being had to be analyzed, from the origin and discuss natural characteristics, helping to the Constitution of the family group that has evolved for years from the promiscuity of matriarchate, to the current patriarchate. The economic subject has had the opportunity of analyzing in the current thesis, based on consultations of positive law, jurisprudence, and habits, as a contribution to the family life in the country.
