Resumen
This article is part of an ongoing doctoral research and presents a comparative analysis that seeks to identify similarities and specificities in the conception of public and private education of the current constitutional and educational bases in Brazil and Argentina. For this, we have turned to the national constitutions, Constitution of the Federative Republic of Brazil of 1988 and Constitution of the Argentine Nation of 1994, and the Education Acts, Act no. 9.394 of 1996 - Act of Policies and Bases of the National Education and Act n° 26.206 of 2006 - National Education Act. The National Constitutions are the highest laws of the countries' legal system and the educational legislations normalize the Education Systems. At first, we contextualize the public and private Brazilian and Argentinian educational system. Secondly, we analyze the legislations of the two countries previously mentioned. Lastly, we present some considerations about the conception of public and private education, its content and the extent of the constitutions and Education Acts.
