Impedimentos en la aplicación efectiva de la Ley de Justicia y Paz en materia de DDR y justicia transicional. Estudio de caso: el surgimiento de las Bacrim en Antioquia (2006-2008)

Abstract

The objective of this case study is to demonstrate to what extent the State’s incapacity influenced the emergence of Bacrim in the department of Antioquia. To this end, the issue is approached from a perspective of both explanatory and analytical, since it seeks to examine the causal relationship between the armed phenomenon in Antioquia and the causes that led to its emergence through the application of the Law of Justice and Peace, with the starting point the incapacity of the State at three levels: economic infrastructure in the Disarmament, Demobilization and Reintegration with the Autodefensas Unidas of Colombia, in justice administration for the process of transitional justice and to retrieve the legitimate monopoly of violence.
