The present article is a preliminary analysis of the constitutional incidence on the scope of the categories, institutions and Colombian’s private law norms. Said analysis will take as a reference the jurisprudence experiences contained in some of the Colombian Constitutional Court’s decisions. From the analysis of two specific cases, the author pretends to explain the scope of some of the constitutionalization’s judicial systems pertaining to the private law in Colombia, in order to offer some dogmatic clues that will give a clear vision and order to a debate that intends to progress in Colombia.
