The first part of this article gives an overview of the North American Free Trade Agreement (NAFTA) dispute settlement mechanism between investors and States (Chapter 11). The relevant provisions will be analyzed in the light of the growing case law. The second part will deal in particular with a recent award rendered in the case of Methanex Corporation v. United States of America, where it was decided that the Tribunal had the power under Article 15 (1) of the UNCITRAL Arbitration Rules and under NAFTA Chapter 11 to accept amicus curiae briefs submitted by several Non-Governmental Organizations (NGOs). It is the first time in the context of NAFTA or in any other investor-State arbitration that amicus curiae briefs hove been accepted from non-State actors. The article examines in detail the reasoning of the Arbitral tribunal and its likely impact in future investor-States dispute settlement mechanisms. A primeira parte deste artigo trata de um resumo do Tratado de Livre Comércio da Norte-América (NAFTA) e questiona acordos entre investidores e Estados (capítulo 11). As normas relevantes serão analisadas sob a luz da crescente quantidade de casos. A segunda parte se ocupará da sentença recente no caso Methanex versos os Estados Unidos da América, onde se decidiu que o Tribunal tinha o poder sob o artigo 15 (1) do UNCITRAL -regras de arbitragem- e sob NAFTA -capítulo 11- para aceitar um reporte amicus curiae submetido por várias organizações não governamentais (ONG). É a primeira vez dentro do contexto de NAFTA ou de processos de arbitragem entre investidores e Estado que amicus curiae tem sido aceito por atores não estatais. O artigo examina em detalhe o razoamento do Tribunal de Arbitragem e seu provável impacto no futuro nos mecanismos de resolução de disputas entre investidores-Estados.
