La presente investigación busca contribuir, desde una perspectiva teórica, al análisis y
determinación de los alcances del derecho a la reparación integral de las víctimas de
esterilizaciones forzadas ocurridas en el Perú durante el segundo gobierno del ex
presidente Alberto Fujimori entre los años 1996 al 2000, de acuerdo a los estándares
internacionales del Derecho Internacional de los Derechos Humanos desarrollados sobre
la materia. En ese sentido, la obligación de reparar a las víctimas es planteada como
consecuencia de la responsabilidad internacional del Estado peruano por la acción directa
de agentes del Estado al diseñar, implementar y ejecutar la política de esterilizaciones
forzadas, por incumplimiento del Estado de las obligaciones generales de respetar y
garantizar los derechos humanos, y por legitimar patrones de discriminación y violencia
generalizada contra las mujeres y poblaciones en situaciones de vulnerabilidad, al
establecer que estamos frente a un caso específico de violencia basada en el género.
Asimismo, se analizan las acciones, avances y retrocesos, que ha realizado el Estado
peruano desde que los casos se hicieran públicos, para luego proponer las medidas que
debería tomar el propio Estado para garantizar de manera adecuada, y de acuerdo al
Derecho Internacional de los Derechos Humanos, la búsqueda de verdad, justicia, y en
especial, reparación de las miles de víctimas que siguen esperando.
