La teoría del constare de delicto en el proceso inquisitorial italiano

Abstract

Comprender el corpus delicti es esencial en el proceso penal mexicano. Desde un punto de vista legal constituye uno de los requisitos constitucionales para poder procesar a una persona. En la práctica su utilidad se extiende a todos los actos procesales más trascendentales sobre la libertad de una persona. Sin embargo, en nuestro ámbito se desconoce el desarrollo del concepto. La denominada teoría del constare de delicto fue la primera etapa de dicho desarrollo. El autor traza un bosquejo de esta teoría, su funcionalidad y sus problemas. Lo anterior con la finalidad de replantear la exigencia del corpus delicti en el proceso penal mexicano. / To understand the corpus delicti is essential in the Mexican criminal trial. From a legal point of view it constitutes one of the constitutional requirements to institute of proceedings. On the practice the utility extends to all the more transcendental legal trial acts, about personal release. However, in our environment the development of the concept is unknown. The denominated theory of constare de delicto was the first stage of this development. The author draws up an idea of is theory, its functionality and its problems. The previous have the purpose to emphasizes the demand of the corpus delicti in the Mexican criminal trial.
