| dc.description | El presente trabajo perfila el concepto de “dignidad humana” con el objetivo de desentrañar qué valores y principios del derecho comprende esta noción. Para ello, después de plantear el problema de la definición y de las diversas posturas axiológicas, pasa a estudiar cuáles son los diversos fundamentos que hacen que la dignidad tenga un valor tan eximio. Se estudia desde la perspectiva metafísica el valor que merece cada uno de los componentes del ser humano: la substancia y los accidentes (espíritu y materia); acto de ser y sus propiedades (v. gr. la libertad, según Polo), esencia, potencias (especialmente el intelecto y la voluntad), actos segundos (acciones humanas) y hábitos (v. gr. virtudes). En contra de las posturas más comunes que se decantan por una única justificación, aquí se entiende que el fundamento de la dignidad humana es múltiple. Delimitado así el tema del fundamento de la dignidad, se evidencia qué comprende este concepto y qué valores están intrínsecamente relacionados (v. gr. el valor divino, el valor de la sociedad, el del medio ambiente, y con carácter más instrumental los valores del amor, la verdad, la libertad y la justicia. Definido el valor de la dignidad humana, se analiza si ella es un valor absoluto o relativo, y qué implicaciones jurídicas tiene adoptar una u otra concepción. Finalmente, a manera de conclusión, se sintetizan seis principios relacionados con la dignidad humana, que recogen organizadamente varias de las conclusiones que se han ido obteniendo a lo largo del estudio. | |

| dc.description | This paper outlines the concept of “human dignity” in order to unravel what values and principles of law includes this notion. To do this, after posing the problem of the definition and the various axiological positions, studying what happens to the various foundations that make eminent dignity has such a value. It is studied from the metaphysical perspective the value it deserves each of the components of the human being: the substance and accidents (spirit and matter); act of being and its properties (v. gr. freedom as Polo), essentially powers (especially the intellect and will) acts seconds (human actions) and habits (v. gr. virtues). Contrary to common positions favoring a single justification, here it is understood that the foundation of human dignity is manifold. Thus defined the subject of the foundation of the dignity, evidenced covered by this concept and what values are intrinsically linked (v. Gr. The divine value, society, the environment, and more instrumental values love, truth, freedom and justice. Defined the value of human dignity, it examines whether it is an absolute or relative value, and what legal implications of adopting one or other conception. Finally, in conclusion, are synthesized six principles related to human dignity, which represent an organized some of the findings that have been obtained throughout the study. | |
