El siguiente discurso analiza uno de los principales tópicos del Derecho en la actualidad: la situación del imperio de la Ley y la deconstrucción conceptual de la soberanía moderna posteriores a las transformaciones que dieron lugar al paradigma constitucional del Estado social y democrático de Derecho. Es un ensayo crítico de meta-teoría útil en que, atendiendo a las condiciones actuales de la capacidad de autodisciplina positiva del Derecho, estos conceptos quedan explicados a partir de las consecuencias que su deconstrucción teórica y epistemológica ha traído consigo desde la crisis del Estado Liberal. Como meta-teoría útil, la descripción de trabajos contemporáneos es principal, pero resulta importante también la crítica de la incorporación marginal de la soberanía y del imperio de la Ley en sus modelos de solución de los problemas de la decreciente eficacia de la vinculación constitucional.37-68romrosa@yahoo.comThe following discourse analyzes one of the principal topics of the Law at present days: the situation of the rule of law and the de-construction of the modern concept of sovereignty. Then, all of the transformations that gave place to the constitutional paradigm of the Social State of Law. Furthermore, this essay represents a meta-theoretical use in which, attending to the current conditions of the capacity of positive auto discipline of Law, remains explained from the consequences that the theoretical and epistemological deconstruction has brought after the crisis of the Liberal State of Law. As meta-theoretical use, the description of how Law works is principal, but it is more important the critique of the marginal incorporation in the sovereignty concept and the rule of law to solve problems and also, how the diminishing efficiency of the constitutional entail works.
