dc.descriptionLa Propiedad Industrial es un área jurídica especializada que conjuntamente con el Derecho de Autor, conforma la Propiedad Intelectual. Su campo de acción se encuentra referido a la industria y al comercio, campos estos de la actividad económica, en los que es deber del Estado brindarle protección legal e institucional. Dentro del ámbito legal es de particular importancia la protección que le preste el Derecho Penal, la cual deberá manifestarse mediante la tipificación de los delitos que afecten directamente a los bienes jurídicos que conforman a la Propiedad Industrial, tales como las patentes, los modelos de utilidad, los diseños industriales y los signos distintivos, entre otros. Tal protección debe considerarse integralmente como advertida/preventiva/persecutoria/sancionatoria. En el caso del Diseño Industrial, esta protección legal/institucional y Penal se brinda integralmente, conforme al sistema jurídico especializado aplicable en esta materia.

Its scope is referred to industry and commerce, these fields of economic activity, which is duty of the State to provide legaland institutional protection. Within the legal framework is particularly important to provide protection by criminal law, which should manifest itself through the penalization that directly affect the legal interests that make up the Industrial Property, such as patents, utility models, industrial designs and trademarks, among others. Such protection should be seen as integrally warned / defensive / persecution / punitive. In the case of Industrial Design, this legal protection / institutional and criminal provides comprehensive, specialized legal system in accordance with applicable in the matter.
