dc.descriptionEl trabajo presentado, comprende dos (2) aspectos de la Ley Orgánica para la Protección del Niño y del Adolescente. La primera, está referida a una especulación teórico doctrinaria sobre el contenido del "interés superior del niño y del adolescente que como norte de la interpretación y de la aplicación está dirigido a los Jueces de protección para la resolución judicial de los diversos problemas que a ellos se les someta. En este aspecto recurrimos a teorías de autores Italianos de renombre Universal para que con esa ayuda y luz podamos ver mejor nuestra normativa de protección. El segundo aspecto, esta referido a la novísima acción de protección con la cual se pretende la defensa de los derechos y garantías difusas y colectivas de niños y adolescentes, que busca imponer obligaciones a los agraviantes, de hacer o de no hacer así como otras medidas cautelares, en defensa de tales derechos y garantías; a la vez que se trata de explica desde el punto de vista práctico su tramitación judicial.

dc.descriptionThe work was presented; it comprises two (2) aspects of the Organic Law for the Protection of Children and Adolescents. The first, is related to a theoretic doctrinal study of the contents of the "superior interest of the child and the adolescent" that as a guide for the interpretation and the application is directed to the Protection Judges for the judicial resolutions of different problems which may be faced by them. Regarding this aspect we take into account theories of famous Italian authors so that with that help and light, we may see better our protection regulation. The second aspect is related to the new protection action with which it is attempted the defense of the collective and diffuse guaranties of children and adolescents, that seek to impose obligations on the offender, as well as other preventive measures for the defense of such rights and guaranties; at the same time it is tried to explained from the practical viewpoint their judicial procedure.
