A chamada cultura do estupro vem apontar comportamentos que silenciam ou relativizam a violência sexual contra as mulheres e, para compreendê-la, faz-se imprescindível o estudo e a abordagem das relações sociais entre os gêneros. Se o Direito é reflexo da sociedade, é possível que o mesmo a reproduza por meio de discursos jurídicos discriminatórios que reforçam os papéis de gênero e a hostilidade contra as mulheres vítimas de crimes sexuais. O objetivo do trabalho é verificar se nos crimes de estupro os operadores do direito agem de modo a reproduzir práticas e discursos que disseminam uma cultura do estupro no Poder Judiciário. O método de abordagem selecionado foi o dedutivo, em conjunto com a técnica de pesquisa bibliográfica e documental. Como resultado, constatou-se que o Judiciário age ativamente na perpetuação e legitimação de uma cultura do estupro mediante preceitos, práticas e discursos que reforçam, justificam e até naturalizam a violência sexual contra as mulheres. The so-called rape culture has brought attention to behaviors that silence or diminish sexual violence against women, and, in order to understand this social concept, the study and the approach of social relations between genders are essential. If the Law is a reflection of society, it may reproduce its discriminatory juridical discourses that reinforce gender roles and the hostility against women victims of sexual crimes. The objective of this work is to verify if, in rape trials, jurists reproduce practices and discourses that spread a rape culture in the Judiciary Power. The approach used in this paper was a deductive one, combined with the bibliographical and documentary research technique. As a result, it was found that the Judiciary acts actively in the perpetuation and legitimation of a rape culture through precepts, practices and discourses that reinforce, justify and even naturalize sexual violence against women.
