This paper proposes to examine how the music education legislation is being effectively implemented in the elementary schools of Chile. Initially, a study was conducted to analyse the laws LOCE, of 1996 and LGE, of 2012, and the musical curriculum proposals that guide the practice of teachers who work in schools. Subsequently, class observations were made and officers involved in music education (Directors and teachers) were interviewed. In the light of the curricular proposals of Bernstein (1993), the concepts of classification and framing were studied for understanding the ideas contained in government programs. The questionnaires for the participant teachers¿ interviews were them organized in categories according to Bardin (2011). At the end it was found that the teachers do not receive sufficient training to employ the programs, the schools do not have the infrastructure for music lessons and that the emphasis given to teaching of Spanish language and mathematics often does not allow the music class to be valued Mestrado Música, Teoria, Criação e Prática Mestra em Música CAPES
