EN ESTE TRABAJO SE REVISAN LAS DISTINTAS POSTURAS QUE EXISTEN Y LA EFECTIVIDAD POTENCIAL DE LOS MECANISMOS COMERCIALES ”EL COMERCIO DE PERMISOS DE EMISIÓN, EL DESARROLLO LIMPIO Y LAS APLICACIONES CONJUNTAS” EN EL RÉGIMEN GLOBAL DEL CAMBIO CLIMÁTICO. DE MANERA PARTICULAR, EL ARTÍCULO EVALÚA MUY EN DETALLE LA POSICIÓN Y LA ACTITUD DE ESTADOS UNIDOS EN CONTRAPOSICIÓN A LA UNIÓN EUROPEA Y LOS PAÍSES EN DESARROLLO. EL ANÁLISIS SE CENTRA EN LA COMBINACIÓN ENTRE DOS TIPOS DE MECANISMOS: EL DE REGULACIÓN, POR IMPUESTO O POR CUOTAS, DEL USO DE LA ENERGÍA DE COMBUSTIBLES FÓSILES, Y EL DE LOS MECANISMOS FLEXIBLES COMERCIALES BASADOS EN LAS LEYES DEL MERCADO. EN EL PLANO CONCEPTUAL EL DEBATE QUE SE DESARROLLA EN TORNO A LA PARTICIPACIÓN COMPARTIDA DE LOS GOBIERNOS Y LOS SECTORES EMPRESARIALES EN LA POLÍTICA Y ECONOMÍA GLOBAL DEL MEDIO AMBIENTE SE VINCULA CON LA PARTICIPACIÓN DE LOS ESTADOS Y DE LAS EMPRESAS, ES DECIR, EL MERCADO EN LA ESFERA DE LA POLÍTICA GLOBAL. SE SOSTIENE LA HIPÓTESIS DE QUE EL GRADO Y TIPO DE PARTICIPACIÓN EN LAS NEGOCIACIONES GLOBALES DE EMPRESAS QUE TIENEN LA CAPACIDAD DE ACTUAR DE MANERA RELATIVAMENTE AUTÓNOMA, PODRÍA CAMBIAR EN EL FUTURO LA NATURALEZA, LA IDENTIDAD Y LA FUNCIÓN DE LOS REGÍMENES INTERNACIONALES. This article reviews the various existing positions and the potential effectiv eness of trade mechanisms: -the trade in emissions permits, clean development and joint applications-within the global regime of climate change. In particular, the article undertakes a detailed analysis of the position and attitude of the United States in contrast to the European Union and developing countries. The analysis focuses on the combination of the two types of mechanisms: the regulation, through taxes or quotas, of the use of fossil fuel energy and flexible trade mechanisms based on the laws of the market. At the conceptual level, the debate on the joint participation of governments and business sectors in global environmental politics and economy is linked to the participation of the states and firms, in other words, the market within the sphere of global politics. The article posits the hypothesis that, in the future, the degree and type of participation in the global negotiations of firms that have the capacity to act relatively autonomously, could change the nature, identity and function of international regimes. Ce travail réexamine les différentes positions qui existent et l'effet potentiel des mécanismes commerciaux -le commerce de permis d'émission, le développement propre et les applications conjointes- sur le régime global du changement climatique. En particulier, l'article évalue de façon très détaillée la position et l'attitude des États-Unis en opposition avec l'Union européenne et les pays en voie de développement. L'analyse est centrée sur la combinaison de deux types de mécanismes: le mécanisme de régulation, par impôts ou quotas, de l'utilisation des énergies fossiles, et celui des mécanismes flexibles commerciaux fondés sur les lois du marché. Sur le plan conceptuel, le débat qui se développe autour de la participation conjointe des gouvernements et des entreprises à la politique et à l'économie globale de l'environnement est lié à la participation des États et des entreprises, c'est-à-dire au marché dans la sphère de la politique globale. On soutient l'hypothèse que le degré et le type de participation aux négociations globales d'entreprises ayant une capacité d'action relativement autonome pourraient dans l'avenir changer la nature, l'identité et la fonction des régimes internationaux.
