O modelo de inovação aberta hélice tríplice: os instrumentos previstos pela lei de inovação em face das normas de direito público

Technological innovation in a national context is one of the most efficient ways to improve international competitivity of a nation and its population life conditions, generating benefits to society and stimulating intern competition, creating new products, processes and ways of production which, in a static way, would not be generated. By that, the pursuing of technological development should be stimulated, encouraging the domestic industry to reinvent itself. The main goal of this study is to analyze the participation of the State in this context, from the activities of the Scientific and Technological Institutions (ICT 's) public in the triple helix innovation model that proposes innovation as an end where the government, academy and industry are main actors in a symbiosis of joint actions that allow the technological development of a nation. From a hermeneutics and a bibliography perspective about norms that rule science, technology and innovation in Brazil, in such Constitutional and infra-constitutional legislation, it analyzes juridically how Brazil is positioning about the innovation and technology issue and the ways to encourage national innovation technology, just as the way to speaking about norms and general principles of the Public Administration with focus on bids and administrative contract, and how these apply in instruments brought by the legal framework of national innovation for the execution of this model, analyzing if exist any legal obstacles and how they will be fulfilled such as constitutional provisions on scientific research and innovation as the fundamental precepts of the Brazilian Public Administration.
