From international trade perspective, the supply of services and in particular the supply of public goods is a
recent issue. The case of education services have been traditionally considered as an activity of the State, associated
to the concept of public goods. Nowadays, this concept has changed, and it’s considered that education can be
an object of trade transactions and also be exported. For Colombia, this subject is important due the negotiations
of the Free Trade Agreement with the United States of America, not only because the special situation of
Colombia like net importer of educational services, but also because the possible effects of this treaty on the
Colombian educational system. The goal of this paper is to analyze services trade disciplines and its application
to educational services –higher education– as well as the concrete implications for Colombia of the negotiations of
a Free Trade Agreement, that may includes under its scope the issue of educational services.
