La situación del Decreto Ley de Amnistía después del fallo Almonacid Arellano

Artículo No disponible a texto completo The ruling issued by the Inter-American Court of Human Rights in the Almonacid Arellano et al. vs. Chile case condemns Chile to comply with the sentence. The Chilean State must determine the means by which it will consolidate and execute the obligations set out in the sentence. This has resulted in an obligation that our legislative power will have to comply with: repealing the Amnesty Law. On the other hand, our Superior Courts have made use of the gradual prescription of the law to favor those who have committed crimes against humanity, violating another principle of International Law of Human Rights: the imprescriptibility of these crimes. This has resulted in what we call in this article a debt of the Chilean State. Our country is in breach of the general duties contained in the Inter-American Convention on Human Rights -an obligation to respect the rights and to adopt domestic legal provisions. It is also infringing specific provisions of the Convention itself that guarantee judicial safeguards and judicial protection for the people. La sentencia del caso Almonacid Arellano y otros versus Chile de la Corte Interamericana de Derechos Humanos, condena a Chile a cumplir lo ordenado. El mismo Estado chileno debe determinar los medios a través de los cuales concretará y ejecutará las obligaciones emanadas de la sentencia. Lo anterior trae como consecuencia una obligación para nuestro poder legislativo: derogar el Decreto Ley (DL) de Amnistía. Por otra parte, nuestros tribunales superiores se han servido de la utilización de la prescripción gradual para favorecer a aquellos que han cometido delitos contra la humanidad, infringiendo otro principio del Derecho Internacional de los Derechos Humanos: la imprescriptibilidad de estos delitos. Lo anterior se traduce en lo que en este artículo denominamos deuda del Estado de Chile. Nuestro país está incumpliendo los deberes generales contenidos en la Convención Interamericana de Derechos Humanos (CIDH) -obligación de respetar los derechos y de adoptar disposiciones de derecho interno, violando además normas particulares de la misma Convención que aseguran a las personas las garantías judiciales y la protección judicial.
